Terms of Use — SoundPull

These Terms of Use ("Terms") govern your use of the mobile application "SoundPull" (the "App"), published by naruberio ("we", "us", "our"). By downloading, installing, or using the App, you agree to these Terms.

1. License — Apple Standard EULA

Your use of the App is licensed, not sold, to you under the standard Apple Licensed Application End User License Agreement ("Apple EULA"), available at:

The Apple EULA is incorporated into these Terms by reference. In case of conflict between these Terms and the Apple EULA, the Apple EULA controls with respect to the matters it covers; these Terms control on all other matters.

2. Eligibility

You must be at least the minimum age required to enter into a binding contract under the laws of your jurisdiction, and you must comply with the terms of the App Store under which you obtained the App.

3. What the App Does

SoundPull extracts the audio track from a video you provide and saves it as an M4A (AAC) audio file. All processing happens on your device using Apple's AVFoundation framework. The App does not upload your videos or audio to any server.

4. Rights in Your Content — You Must Have the Right to Use It

SoundPull is intended for use only with video content that you own or are otherwise authorized to use, such as videos you recorded yourself. By using the App, you represent and warrant that you have all necessary rights to the videos you process and to the audio you extract from them.

You must not use the App to:

• Circumvent, disable, or bypass any digital rights management (DRM), encryption, or copy protection;
• Extract, copy, or save audio from content you do not own or are not authorized to use, including DRM-protected, purchased, rented, or streamed media;
• Infringe the copyright, trademark, or other intellectual property or privacy rights of any person or company.

To support this, the App refuses to process DRM-protected content and does not provide any means of removing or bypassing content protection. You are solely responsible for ensuring that your use of the App complies with applicable law and with the rights of third parties.

5. Your Content

You retain full ownership of the videos you provide and the audio you extract ("Your Content"). Because all processing happens locally on your device and nothing is transmitted to us, we have no access to Your Content and claim no rights over it. You are solely responsible for Your Content and for backing it up if you wish to preserve it.

6. In-App Purchases

The App provides a free allowance of extractions and offers a single one-time, non-consumable in-app purchase (the "Unlock") that removes the limit and enables unlimited extractions. The purchase:

• Is processed by Apple Inc. through the App Store.
• Is non-refundable by us. Refund requests must be directed to Apple at https://reportaproblem.apple.com.
• May be restored on devices using the same Apple ID via the in-app Restore Purchase function.

Prices are displayed in your local currency at the time of purchase and are set by Apple based on the price tier selected by us.

7. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the App, except to the extent permitted by applicable law.
• Use the App for any unlawful purpose or in violation of section 4.
• Interfere with or disrupt the App's operation.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or that every video or codec can be processed, or that defects will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE OR APPLE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

Our total cumulative liability arising out of or relating to the App will not exceed the amount you paid (if any) for the App in the twelve (12) months preceding the claim.

10. Data and Privacy

The App does not collect any personal data. See the Privacy Policy for details. You are responsible for any content you create with the App and for backing it up if it is important to you. Uninstalling the App will delete all locally stored data.

11. Termination

You may stop using the App and uninstall it at any time. We may discontinue, suspend, or modify the App at any time without notice. These Terms remain in effect for any provisions that by their nature should survive termination (e.g., disclaimers, limitations of liability).

12. Changes to These Terms

We may update these Terms. Material changes will be reflected by updating the "Effective date" above. Continued use of the App after a change indicates acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of Japan, excluding its conflict-of-law rules. Any dispute arising out of or related to these Terms or the App will be resolved exclusively in the courts of Fukuoka, Japan, except where prohibited by applicable consumer protection law.
